On October 26, 2023, the Hon’ble Court of Appeal of Sharjah delivered a landmark judgment on cross-appeals, stemming from a claim lodged by a UAE-based prominent Subcontractor against the Main Contractor and a Leading Middle-East Conglomerate (Employer), facing a substantial claim of AED 29 Million and the Engineer, with a claim of AED 1 Million respectively.
This case encompassed a spectrum of complex issues, including privity of contract, jurisdiction of the Court, Engineer’s liability, the application of FIDIC Conditions of Contract and FIDIC Conditions of Subcontract, Extension of Time claims, variations, and the interpretation of UAE laws.
